Talk and Win Terms and Conditions TERMS AND CONDITIONS FOR DIGICEL TALK & WIN CRICKET PROMOTION   1.        The Talk & Win Cricket Promotion (“the Promotion”) is applicable to the following markets: o       Jamaica o       Trinidad o       Barbados o       Guyana o       Antigua o       Cayman o       St Kitts o       Grenada o       St Lucia o       Dominica 2.       The Promotion is available to all Digicel Customers in the markets listed above (“Customers”). 3.        The Promotion will run from 11 May to 16 June 2009. (“the Promotion Period”) 4.       To be eligible for the Promotion, Customers must make calls lasting for at least [xx] minute(s) every [day/week]. A phone call that is shorter than [xxx] will not count towards this Promotion. 5.       To be eligible to win, Customers accounts must be active and in good standing at the time of the prize draw.  If calls to a Customer number are barred, where service to a Customer number has expired or has been deactivated or where a warning has been issued to a Customer in relation to service to their Customer number the Customer will not be eligible to win. 6.        The Promotion applies to [local OR local and international] calls however any calls made from bonus credit do not apply to the Promotion. 7.       To qualify for the Promotion, Customers must make these calls in their local market, calls made whilst roaming do not apply to the Promotion.  8.       Once a Customer meets the criteria detailed above, the Customer’s details are entered into a local prize draw from which the winners are chosen. 9.       In each market there will be one winner of a Blackberry Curve 8900 handset (“the Local Prize”) 10.     The prize draw for the Local Prize will be on  17 June 2009 11.     The winner of the Local Prize will be notified [HOW AND ON WHAT DATE] 12.     Digicel has identified redemption centres at which the winners may come to collect the Local Prizes. If the Local Prizes are at the redemption centre for more than a two-week (14 days) period, they will be given to charity. 13.     The winners of the Local Prizes in each market will be entered for the draw of prize of a trip for 2 to see two of the Digicel West Indies v India One Day International Cricket Matches in Jamaica on 26 June 2009 (“the Grand Prize”) 14.     The Grand Prize includes (a) round-trip, economy-class air transportation, for use solely by the prize recipient and their guest to Jamaica, (b) five (5)  nights’ hotel accommodations (in a single room to be shared by the prize recipient and their guest), and (c) tickets to the Sabina Park Cricket ground for two (2) days to see the West Indies vs India for the 1st and 2nd Digicel One Day Internationals, (d) spending money of  USD50 per diem per person per day. 15.     Travel insurance is not included; where Departure Tax is not added to the price of the airline ticket this must be borne by the prize winner and their guest. 16.     All costs and expenses not expressly included herein in connection with the prize (including, without limitation, transportation to and from airport of origin, food and beverages, and other incidental costs), and all applicable taxes, will be the sole responsibility of the actual prize recipient and their guest. 17.      Air transportation may require connecting flights. We reserve the right to require the travellers to fly on certain days of the week, and/or at certain times of the day or night, and/or on certain airline carriers. 18.     The winner of the Grand Prize and their designated guest must be able and available to travel together on the same itinerary and must be able and available to travel on those particular travel dates that we may specify. Hotel accommodations will be at a hotel selected by Digicel. The prize trip is subject to availability and confirmation of reservations. 19.     The guest of the Grand Prize winner must be 18 years of age or older, unless such guest is a member of the Winner’s immediate family. 20.     20.    Flight details are subject to space availability, and the airline carrier’s regulations and conditions apply. The prize trip may not be combined with any other offer, and travel may not qualify for frequent flyer miles. Certain additional restrictions and blackout dates may apply. Airline tickets are non-refundable, non-exchangeable, non-transferable, not redeemable for cash, and not valid for upgrades. 21.     Passport and visa requirements are the responsibility of the prize winner and their guest and they will need to confirm their ability to travel by the [DATE] 2009 If the prize winner does not by the [DATE] 2009 have a passport or any required visa the prize is forfeited and another finalist with the next highest number of votes will win the prize. 22.     The winner of the Grand Prize and their guest must satisfy themselves that they are fit to travel to take up the prize. If in doubt, medical advice must be taken and acted upon by prize winner and their guest. 23.     Only persons eighteen (18) or older, on the date of the relevant draw, can claim prizes. Proof of age of the winner is required before redeeming a prize. 24.     Digicel employees, dealer principals or employees of any of our affiliated companies, advertising, promotion and public relations agencies, dealers, distributors, or anyone else connected with this promotion and their immediate family members and household members are not eligible for entry. For these purposes immediate family members are spouses, parents, siblings and children. 25.     All winners will be required to participate in any planned publicity in connection with this Promotion and by entering the Promotion, the prize winner consents to the use of their name, likeness, image, photograph for any and all programming and/or publicity promotion or advertising purposes, commercial or otherwise, in all media and formats used by us or our agencies, without further compensation, throughout the entire world in perpetuity. If a winner refuses to do so, they forfeit their right to claim the prize. 26.     Digicel hereby specifically reserves the right to terminate, cancel, suspend and/or modify the Promotion if any fraud, virus or other technical problem corrupts the administration, security, safety or proper play of the Promotion, as determined by Digicel in its sole discretion. In such event, Digicel hereby specifically reserve the right (but not the obligation) to award some other prize hereunder (as determined by Digicel in its sole discretion) by means of a random drawing from among the eligible entries received up until the time of the impairment. 27.     Digicel reserves the right to at any time vary the terms of the Promotion, to amend its Terms and Conditions, or to withdraw the Promotion. In any of these events notice will be given via media advertisements or messages to subscribers and will be effective immediately or as of the date referred to in such notifications. 28.     The general Terms and Conditions governing the relationship between Digicel and both its Digicel FLEX Subscribers and its Digicel SELECT Subscribers are set out in Digicel FLEX Terms and Conditions and Digicel SELECT Terms and Conditions. 29.     Digicel is not responsible under any circumstances for, and hereby irrevocably are released and held harmless by all entrants from and against, any and all lost, interrupted or unavailable network server or other connections, miscommunications, failed telephone or transmissions or technical failure, jumbled, scrambled or misdirected transmissions, incorrect or inaccurate entry information, howsoever caused, or other errors of any kind, whether human, mechanical or electronic. 30.     Subscribers found to be tampering with or abusing any aspect of this Competition, as solely determined by Digicel or the judges, will be disqualified from any further participation in this Competition and will become ineligible to receive any prize hereunder. Any attempt by any person deliberately to undermine the legitimate operation of the Competition may be in violation of criminal and civil law, and should such an attempt be made, Digicel hereby specifically reserve the right (among other causes of action and remedies) to seek and obtain damages from and against any such person to the fullest extent permitted by law. Digicel’s failure to enforce any provision of these official rules shall not constitute a waiver of that provision (or of any other provision hereunder). 31.     All the prizes are personal and cannot be transferred by winners. 32.     A third party cannot claim a prize on behalf of a winner even with a valid power of attorney. 33.     The Prize is as stated and cannot be exchanged or refunded. 34.     In the event of unforeseen circumstances Digicel reserves the right to offer an alternative prize without notice. No cash alternatives will be offered. 35.     This promotion is subject to all applicable laws. Taxes, including personal income tax, payable on any prizes are the winner’s sole responsibility. 36.     We accept no responsibility for any prize forfeited in any way.
